Property Agent App — Terms & Conditions

Welcome to Property Agent App. These Terms & Conditions (“Terms”) govern your access to and use of the Property Agent App mobile application, the webpages we generate for property listings, and related services and features (collectively, the “Service”), including creation and sharing of property listings and Subscription plans. By registering, downloading, accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

If you are using the Service on behalf of a company or other legal entity, you represent that you are authorised to accept these Terms on that entity’s behalf and “you” and “your” will refer to that entity.


1. Definitions

  • We, us, our, and Property Agent App mean the operator of the Service.
  • User Content means all content you submit, publish or display on or through the Service, including property descriptions, photos, floorplans, contact details and links (“Listings”).
  • Listing Page means any webpage generated or hosted by us that displays a Listing you created with the Service.
  • Subscription means any paid plan for access to features of the Service.

2. Eligibility

  • You must be at least 18 years old and legally capable of entering into binding contracts.
  • You must comply with all applicable local, national and international laws (including, where relevant, licensing requirements for real estate agents and AML/KYC rules).

3. Accounts, Security and Verification

  • You must provide accurate, current and complete registration information and keep it up to date.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • We may require identity verification, proof of real estate licensing or other checks. We may suspend or restrict accounts that fail verification or that violate these Terms.
  • You should secure your account (for example, enable two-factor authentication where available).

4. User Content, Listings and Licence

  • You retain ownership of intellectual property rights in your User Content.
  • By submitting User Content you grant us a non-exclusive, royalty-free, transferable, sublicensable, worldwide licence to host, reproduce, adapt, modify, publish, translate, distribute, display and create derivative works of the User Content for the purpose of providing, promoting and improving the Service (including creating Listing Pages and sharing Listing Page links).
  • You represent and warrant that you have all necessary rights, licences and permissions to upload and publish the User Content, and that the User Content is true, accurate and not misleading.
  • You must not post User Content that:
    • Violates any law or regulation (including data protection, consumer protection, advertising or anti-discrimination laws such as fair housing laws);
    • Infringes third-party intellectual property or privacy rights;
    • Is fraudulent, misleading or otherwise harmful (including false listings or fake availability);
    • Is unlawful, obscene, defamatory, harassing, discriminatory or promotes illegal activity.
  • We may remove, refuse or disable access to any User Content that violates these Terms or for any other reason in our discretion. We are not obligated to host or retain User Content.
  • The Service can create public Listing Pages viewable by anyone with the link. You are solely responsible for the content and any interactions resulting from sharing Listing Page links.
  • We do not guarantee that Listing Pages will be available at all times (hosting downtime, maintenance, or other issues may occur).
  • You may remove or edit your Listings. Deleted Listings or Listing Pages may persist in backups or caches for a reasonable time.
  • Third parties who access Listing Pages may copy, mirror or redistribute information and images you post; you are responsible for what you publish publicly.

6. Paid Subscriptions, Pricing and Payment

  • The Service offers Subscription plans with different features and pricing. Subscription fees, billing cycles and included features are described in the app and on our website.
  • Payment methods may include in-app purchases via Apple App Store or Google Play, or direct payment processors. If you purchase through a mobile platform (Apple/Google), their billing, refund and cancellation policies may apply in addition to these Terms.
  • Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You authorise us (or the applicable payment processor) to charge the payment method you provide for the applicable fees and taxes.
  • Prices are shown in the currency specified and may be exclusive of VAT or other applicable taxes. You are responsible for all taxes associated with your Subscription.
  • You must keep payment information current. If a payment is declined, we may suspend or terminate your access to paid features.

7. Cancellations and Refunds

  • You may cancel your Subscription at any time. Cancellation will prevent future renewals but does not generally result in a refund for the current billing period, unless required by law or expressly provided in a refund policy published by us.
  • For Subscriptions purchased via third-party platforms (Apple/Google), follow the platform’s cancellation and refund process.
  • We may, in our discretion or as required by law, issue refunds or credits.

8. Free and Promotional Offers

  • Promotional discounts, coupons or special offers may have additional terms (limited time, limited to specific users, etc.). We may modify or terminate promotions at any time.

9. Intellectual Property Rights

  • We and our licensors own all rights, title and interest in and to the Service, software, trademarks, trade names, logos, documentation and other content created by us, except for User Content.
  • You may not copy, modify, create derivative works from, distribute, sell, reverse engineer or otherwise exploit the Service, except as expressly permitted by law or with our written permission.

10. Prohibited Activities

You must not, directly or indirectly:

  • Use the Service for unlawful, fraudulent or harmful activities.
  • Post Listings that infringe intellectual property or privacy rights, or that are discriminatory or deceptive.
  • Access, tamper with or use non-public areas of the Service, or attempt to probe, scan, or test vulnerabilities or breach security.
  • Use automated means (bots, scrapers) to access, collect or index content from the Service without our consent.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Impersonate other persons or create multiple accounts for abusive or deceptive purposes.

11. Compliance with Laws and Real Estate Regulations

  • You are responsible for complying with applicable real estate, advertising, consumer protection and licensing laws in your jurisdiction. If you are an estate agent, you must hold and maintain any required license to offer or advertise property.
  • You must follow applicable fair housing and anti-discrimination laws in your listings and communications.
  • You must comply with data protection requirements (e.g., GDPR) in respect of any personal data you collect, process or share through the Service.
  • The Service may contain links to third-party websites, services or ads. We do not endorse and are not responsible for third-party content, services, privacy practices or transactions.
  • Payment processing, analytics and other functionality may be provided by third-party vendors. Use of such services is subject to the vendors’ terms.

13. Privacy

  • Our Privacy Policy explains how we collect, use and share information about you and applies to your use of the Service. By using the Service you consent to collection and use of personal data as described in the Privacy Policy.

14. Warranties and Disclaimers

  • THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT.
  • WE DO NOT WARRANT THAT THE SERVICE, LISTING PAGES OR THE CONTENT ON THEM ARE ACCURATE, COMPLETE OR RELIABLE. YOU ARE RESPONSIBLE FOR VERIFYING ANY INFORMATION BEFORE RELYING ON IT.
  • WE DO NOT GUARANTEE THE IDENTITY, BACKGROUND OR CREDIBILITY OF OTHER USERS.

15. Limitation of Liability

  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT OF SUBSCRIPTION FEES YOU ACTUALLY PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM. IF YOU HAVE NOT PAID FEES, OUR LIABILITY SHALL BE LIMITED TO EUR 100.
  • IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL, PUNITIVE OR SPECIAL DAMAGES, LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF DATA, OR LOSS OF GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • Some jurisdictions do not allow certain limitations, so this limitation may not apply in all cases.

16. Indemnification

  • You agree to indemnify, defend and hold harmless Property Agent App, its affiliates, officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising from or related to:
    • (a) your User Content or Listings;
    • (b) your violation of these Terms;
    • (c) your breach of any law or third-party right; or
    • (d) your use of the Service.

17. Termination and Suspension

  • We may suspend or terminate your account, access to Listing Pages or the Service at any time for violation of these Terms or for any other reason in our discretion. Termination does not relieve you of obligations accrued prior to termination.
  • If we terminate for cause (violation of these Terms), you may not be eligible for refunds.
  • You may close your account by following the in-app account deletion process or contacting support. Deleting your account may not delete copies of your User Content retained in backups or for legal reasons.

18. Changes to the Service and These Terms

  • We may modify or discontinue the Service (or any part) at any time, temporarily or permanently, with or without notice.
  • We may change these Terms from time to time. If changes are material, we will provide notice (e.g., via the app or email). Your continued use after the effective date of revised Terms constitutes acceptance.

19. Dispute Resolution and Governing Law

  • These Terms are governed by and construed in accordance with the laws of Pennsylvania, without regard to conflict of law principles.
  • For disputes, you agree to first contact us to seek an amicable resolution. If we cannot resolve the dispute, the exclusive courts of Pennsylvania shall have jurisdiction over all disputes arising from or relating to these Terms, to the extent permitted by applicable law.
  • To the extent permitted by law, you and we expressly waive any right to a trial by jury or to participate in a class action.

20. Force Majeure

  • We are not liable for delays or failures in performance resulting from causes beyond our reasonable control (strikes, acts of God, emergencies, network failures, pandemics, governmental actions).

21. Notices

  • We may provide notices by email, push notification or posting within the app. You may provide notices by contacting support at the address below.

22. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy and any other documents expressly incorporated by reference, constitute the entire agreement between you and Property Agent App regarding the Service.
  • Severability: If any provision is invalid or unenforceable, the remainder of these Terms will remain in full force.
  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • No Waiver: Our failure to enforce any right is not a waiver of that right.
